APD takes out warrants against shooting victim

  • Two warrants accuse a shooting victim of breaking into cars before he was shot in the parking lot of an Albany motel.

ALBANY — An Albany man injured after being shot by a man police say was trying to protect his property in a motel, is still being sought by police on at least two criminal warrants after being released from a local hospital, authorities say.

Charles Henderson III was treated for a gunshot wound at Phoebe Putney Memorial Hospital after police say John Underwood shot Henderson as he was speeding away from the parking lot of the Comfort Suites on Dawson Road July 29. Underwood told them he saw Henderson tampering with vehicles in the parking lot.

Underwood has been charged with aggravated assault and bonded out of the Dougherty County Jail.

Police issued two felony entering-auto warrants against Henderson Friday. But when Dougherty County Sheriff’s deputies went to serve those warrants Monday, Henderson had been released from the hospital and was back on the streets.

“It looks like they just missed getting him,” APD spokesperson Phyllis Banks said. “The warrants were written up Thursday but weren’t entered into GCIC (the Georgia Crime Information Computer) until after 5 p.m. Friday.”

The two warrants accuse Henderson of stealing items from cars in the parking lot of the Comfort Inn July 27 and 28. Banks said that the investigation is ongoing and that Henderson could face additional charges.
