ALBANY, Ga. — The Albany City Commission will vote at its business meeting tonight on a resolution that will settle three pending lawsuits fire department employee Roderick Jolivette has against the city.

According to the resolution, the city will pay Jolivette $185,000 from its risk management fund, and Jolivette will release all claims he has pending against the city and its officials and employees. Jolivette agrees not to seek future employment with the city, and he will receive additional years of credited service toward his pension as if he remained employed through his normal retirement date.

Jolivette has two suits pending against Albany Fire Department Chief James Carswell and one against the city of Albany. There is also an EEOC notice of charge that will be withdrawn as part of the settlement.

Contacted Monday afternoon, Carswell said he could not comment on the matter. City Manager James Taylor also declined to comment, but he said money for the settlement would not impact the city’s general fund.

The settlement is the second Jolivette has received from the city, and he has also reached settlements with Dougherty County and Marine Corps Logistics Base-Albany.
