Pedestrian killed in East Albany early Monday

ALBANY — No charges are expected in a pre-dawn pedestrian death Monday.

The incident took place around 5:30 a.m. at 1200 S. Mock Road. Phyllis Banks, spokeswoman for the Albany Police Department, said that 42-year-old Wesley Alvis was driving a 2012 Chevrolet Silverado C-1500. Johnny Burns, 52, was walking north on South Mock Road in the central turning lane when Alvis, who also was traveling north on Mock Road, entered the central turning lane, did not see Burns and hit him, according to police.

Burns died from his injuries, Banks said.

The investigation found that Burns, wearing dark clothing and in an area that is not well lighted, was walking in the middle of the roadway when he was struck.

There were no indications of intoxication or impairment of the motorist, officials said.

No charges were expected to be filed, Banks said.
